the Tail Trails Club mobile application, website, and related services
(collectively, the "Service"). By creating an account or using the
Service, you agree to be bound by these Terms. If you do not agree,
do not use the Service.

The words whose initial letters are capitalized have meanings defined
under the following conditions. The following definitions shall have
the same meaning regardless of whether they appear in singular or in
plural.

<p>For the purposes of these Terms:</p>

<strong>Application</strong> refers to Tail Trails Club, the
software program provided by the Company for tracking dog walks.

<strong>Company</strong> (referred to as either "the Company",
"We", "Us" or "Our" in these Terms) refers to Tail Trails Club.

<strong>Country</strong> refers to: Portugal

<strong>Content</strong> refers to any trails, routes, photos,
dog profiles, group information, comments, or other material you
create, upload, or share through the Service.

<strong>Device</strong> means any device that can access the
Service such as a mobile phone or tablet.

<strong>Groups</strong> means the families and packs you can
create or join, including the dog families (one per user) and
packs (unlimited) used to share trails and coordinate dog
ownership.

<strong>Service</strong> refers to the Application and the
website.

<strong>You</strong> means the individual accessing or using the
Service, or the company, or other legal entity on behalf of which
such individual is accessing or using the Service, as applicable.

<h2>Your Account</h2>
<p>
To use most features of the Service you must create an account. You
agree to provide accurate, current, and complete information when
registering, and to keep that information updated. You are solely
responsible for maintaining the confidentiality of your account
credentials and for all activity that occurs under your account.

You must be at least 16 years old to create an account. If you are
the parent or legal guardian of a child and you consent to their use
of the Service, you remain responsible for their activity.

You may delete your account at any time through the app settings or
by requesting deletion via our <a href="/forget-me">account deletion
page</a>. Deleting your account will remove your Content and Personal
Data subject to the retention periods described in our <a
href="/privacy">Privacy Policy</a>.

<h2>The Service and How It Works</h2>
<p>
TailTrails lets you record, save, and share your dog walks. When you
understand the features, you also understand the responsibilities
that come with them:

<strong>Walk recording.</strong> The Service uses your Device's
GPS and motion sensors to record the route, distance, and pace of
your walks, including in the background while the app is closed
or your screen is locked. You grant permission for this through
your Device settings and may withdraw it at any time. Recording
requires a supported Device with location and motion capabilities
and may be affected by signal quality, battery level, and
background limits imposed by your operating system.

<strong>Dog profiles and trail matching.</strong> You may create
profiles for your dogs and provide traits such as dog tolerance,
heat sensitivity, prey drive, nervousness around people, and
off-leash reliability. The Service uses these traits to produce a
trail match score. These scores are estimates only and are
provided to help you decide; they are not a guarantee of safety
or suitability for your dog.

<strong>Trail discovery.</strong> The Service helps you discover
and search trails. Trail information (including dog traffic, foot
traffic, exposure, off-leash status, and wildlife) is provided as
a general guide and may be incomplete, out of date, or inaccurate.
Always assess conditions yourself before and during a walk.

<strong>Groups, sharing, and visibility.</strong> You may create
or join families and packs, invite other users by email, share
trails with audiences you choose (private, family, pack, or
public), and share joint ownership of a dog with co-owners. You
are responsible for the Content you share and for respecting the
permissions and privacy of others in your Groups.
</p>

<strong>Social features.</strong> You may follow other users,
view shared trails, and interact with public Content. Be mindful
that anything you mark public can be viewed and shared by others.
</p>
</li>
<li>
<p>
<strong>Collectibles.</strong> The Service may award digital
collectibles for activity. These collectibles have no monetary
value, are not transferable except where the Service expressly
permits, and may be changed or discontinued at any time.
</p>
</li>
<li>
<p>
<strong>Photos.</strong> With your permission, the Service can
access your camera and photo library so you can take and attach
photos during and after walks.
</p>
</li>
</ul>
<h2>Your Content and License</h2>
<p>
You retain ownership of the Content you submit to the Service. By
submitting Content, you grant the Company a worldwide,
non-exclusive, royalty-free, sublicensable, and transferable license
to host, store, use, display, reproduce, and distribute that Content
solely as necessary to operate, provide, improve, and promote the
Service and its features, including sharing it with the audiences you
select.

<p>You represent and warrant that your Content:</p>
<ul>
<li>Is accurate and belongs to you, or you have the right to share it.</li>
<li>Does not infringe the rights of any person or animal, including
privacy and image rights of people or dogs that appear in your
photos.</li>
<li>Complies with these Terms and all applicable laws.</li>
</ul>
<h2>Acceptable Use</h2>
<p>You agree not to:</p>
<ul>
<li>Use the Service for any unlawful, harmful, or abusive purpose.</li>
<li>Record or share trails on private property without permission, or
encourage others to trespass or ignore local leash laws, trail rules,
or access restrictions.</li>
<li>Harass, threaten, or impersonate other users, or share someone's
dog or personal information without consent.</li>
<li>Upload Content that is false, misleading, defamatory, or that
contains unsuitable or graphic material.</li>
<li>Attempt to access, disrupt, or reverse-engineer the Service, its
backend, or its APIs.</li>
<li>Use bots, scrapers, or automated means to collect data from the
Service.</li>
<li>Interfere with the match scoring, location recording, or other
Service calculations by submitting spoofed or manipulated data.</li>
</ul>
<h2>Safety and Responsibility</h2>
<p>
The Service is a recreational tool to make dog walks more fun. It is
not a substitute for responsible dog ownership, professional training
or veterinary advice, or your own judgment. You are solely
responsible for the safety and behavior of yourself, your dog, and
anyone you walk with. You walk at your own risk and assume full
responsibility for any injury, loss, or damage arising from any walk
you take or trail you follow.

<p>
Match scores, trail details, route maps, distances, and pace are
estimates and may be wrong. GPS and location data can be inaccurate,
intermittent, or unavailable. Do not rely on the Service for
navigation, emergencies, or critical decisions.
</p>
<h2>Subscriptions and Payments</h2>
<p>
Some features of the Service may require payment, such as
subscriptions or in-app purchases. Where offered, purchases are
processed by the platform provider (Apple App Store or Google Play)
and are subject to their terms and pricing. Subscriptions
automatically renew unless cancelled at least 24 hours before the end
of the current billing period through your platform account
settings. Fees are non-refundable except where required by law or by
the platform provider's policy.

<h2>Intellectual Property</h2>
<p>
The Service, including its name, logo, design, software, collectible
artwork, and non-user Content, is owned by the Company and protected
by intellectual property laws. These Terms grant you no rights to the
Company's intellectual property except the limited license needed to
use the Service. "Tail Trails Club", "TailTrails", and related marks
are trademarks of the Company.

<h2>Third-Party Services</h2>
<p>
The Service uses third-party services for authentication, maps,
analytics, and notifications, and may contain links to third-party
websites. The Company is not responsible for the practices or
Content of third parties. Your use of third-party services is subject
to their own terms and policies.

<h2>Disclaimers</h2>
<p>
The Service is provided "AS IS" and "AS AVAILABLE" without warranties
of any kind, whether express or implied, including implied
warranties of merchantability, fitness for a particular purpose, or
non-infringement. The Company does not warrant that the Service will
be uninterrupted, error-free, secure, or that location recordings,
match scores, or trail information will be accurate or reliable.

<h2>Limitation of Liability</h2>

To the maximum extent permitted by applicable law, the Company and its
affiliates, service providers, and licensors shall not be liable for
any indirect, incidental, special, consequential, or exemplary
damages, or for any loss of data, location recordings, photos, or
Content, arising from your use of or inability to use the Service.

To the extent permitted by law, the Company's total liability for any
claim arising from or relating to the Service shall not exceed the
amount, if any, you have paid to the Company for the Service in the
twelve months preceding the claim.

<h2>Termination</h2>

You may stop using the Service and delete your account at any time.
The Company may suspend or terminate your access to the Service at any
time, with or without cause or notice, including if you violate these
Terms. Upon termination, your right to use the Service ends, and
your Content and Personal Data will be handled in accordance with our
Privacy Policy.
